SMOKIN' CHIPOTLE ® Trademark Registration
On August 28, 2008, the UNITED STATES TRADEMARK OFFICE dismissed Kraft Foods opposition upon publication, with prejudice, against Chuck Evans' new SMOKIN' CHIPOTLE® registration. On October 7, 2008, the UNITED STATES TRADEMARK OFFICE GRANTED REGISTRATION No. 3,512,566 SMOKIN' CHIPOTLE ® to Chuck Evans.
SMOKEY CHIPOTLE ®
In December 2007, the UNITED STATES TRADEMARK TRIAL and APPEAL Board upheld Chuck Evans' SMOKEY CHIPOTLE ® trademark registration, dismissing with prejudice a cancellation proceeding (2006) alleging generic descriptive use of the trademark SMOKEY CHIPOTLE ®.
Chuck Evans' trademark is the very first trademark filed in the United States Trademark Office utilizing the word chipotle, where the word chipotle itself is disclaimed; filed (1993) and granted registration (1995) in Class 30.
